NOTICE TO BIDDERS FOR FUEL

 

SEALED PROPOSALS will be received by the Municipal Clerk of the Borough of Beachwood, in the Beachwood Municipal Complex, 1600 Pinewald Road, Beachwood, New Jersey no later than August 2, 2019 at 10:00 a.m. at which time bids will be opened and publicly read for the following:

TO OBTAIN GASOLINE AND DIESEL FUEL RETAIL

SUPPLIER OPEN 24 HOURS PER DAY AND 7 DAYS PER WEEK TO CHARGE THE BOROUGH THE POSTED SERVICE STATION PRICE LESS TAXES AS A RESULT OF THE BOROUGH'S STATUS AS A MUNICIPAL CORPORATION AND INSTRUMENTALITY OF THE STATE OF NEW JERSEY FOR THE YEARS OF 2019 to 2021.

General Bidding Requirements are found at Exhibit A; Bid Packets can be found by contacting the Municipal Clerk, 1600 Pinewald Road, Beachwood, New Jersey (732) 286-6000 and may be acquired during the hours of 8:30 a.m. to 4:30 p.m. Monday through Friday.

Bidders are required to comply with the requirements of P.L. 1975, c.127.

NOTICE TO BIDDERS

PUBLIC NOTICE IS HEREBY GIVEN that sealed bids will be received by the BOROUGH OF BEACHWOOD for the POLICE DEPARTMENT AIR CONDITIONER REPLACEMENT – RE-BID in BOROUGH OF BEACHWOOD, OCEAN County, New Jersey.

Bid forms, contracts and specifications are on file at the office of Remington and Vernick Engineers, 9 Allen Street, Toms River, New Jersey 08753.

Said Bids will be received, opened and read aloud in public at the Borough of Beachwood Municipal Building, 1600 Pinewald Road, Beachwood, NJ 08722 on April 2, 2019 at 11:00 a.m.

Copies of the bid forms, contracts and specifications may be obtained from said Remington and Vernick Engineers, by prospective bidders upon request, upon payment of the sum of $50.00 for each set.

PAYMENT MUST BE RECEIVED PRIOR TO OBTAINING SAID SPECIFICATIONS, EITHER BY MAIL OR IN PERSON.

NO BIDS ARE TO BE DROPPED OFF AT THE ENGINEER’S OFFICE.

The Borough Of Beachwood reserves the right to consider the bids for sixty (60) days after the receipt thereof, and further reserves the right to reject any or all bids, either in whole or in part and also to waive any informality in any and make such awards or take action as may be in the best interest of the Borough Of Beachwood.

Bids must be on the bid form prepared by Remington and Vernick Engineers, in the manner designated therein and required by the specifications, must be enclosed in sealed envelopes bearing the name and address of the bidder on the outside and also bearing on the outside reference to the particular work bid upon. Said bids shall be addressed to SUSAN A. MINOCK, RMC, Municipal Clerk, 1600 Pinewald Road, Beachwood, NJ 08722.

Each bid shall be accompanied by a certified check, cashier’s check or bid bond duly executed by the bidder as principal and having as surety thereon a surety company approved by the Borough of Beachwood in an amount not less than ten percent (10%) but in no case in excess of $20,000.00 of the amount bid. Any such bid bond shall be without endorsement or conditions. Bid shall also be accompanied by a certificate letter from a surety company stating that it will provide the bidder with the completion bond.

The award of the contract shall be made subject to the necessary moneys to do the work being provided by the Borough of Beachwood in a lawful manner. The contract to be executed by the successful bidder will provide that it shall not become effective until the necessary moneys to do the work have been provided by the Borough of Beachwood in a lawful manner. The award shall further be subjected to the securing of necessary State, Federal or Local permits governing the work.

Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 (P.L. 1975, c.127, Affirmative Action); P.L. 1963. C150 (New Jersey Prevailing Wage Act); and Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et.seq.).

The contractor is further notified that he must comply with P.L. 1977, c. 33, and submit a Disclosure Statement listing stockholders with his bid.

The contractor is further notified that he must comply with P.L. 1999 c.238 Public Works Contractor Registration Act and he and any subcontractors must be registered in accordance with the act.

The contractor is also further notified that he must comply with P.L. 2004 c. 57 and submit proof of business registration and submit proof of business registration for any named subcontractors in accordance with the act.

RESOLUTION 2019-11 AUTHORIZING PROFESSIONAL SERVICES AGREEMENTS FOR THE YEAR 2019 UNDER THE FAIR AND OPEN PROCESS

WHEREAS, the Local Public Contracts Law N.J.S.A. 40A;11-1 et seq. requires that notice with respect to contracts for professional services awarded without competitive bids must be publicly advertised.

NOW, THEREFORE, BE IT RESOLVED by Mayor and Council of the Borough of Beachwood, County of Ocean, State of New Jersey as follows:

The awards stated in the within resolutions are awarded without competitive bidding as Professional Services in accordance with Local Public Contracts Law, N.J.S.A. 40A: 11-5(1)(a)

"because they are for services performed by persons
authorized by law to practice a recognized profession."

Hornidge Municipal Complex, 1600 Pinewald Road, Beachwood, NJ, that the above named appointments are being awarded through the Fair and Open process for the calendar year 2019 and the Mayor and Municipal Clerk are hereby authorized and directed to execute professional service contracts.

BE IT FURTHER RESOLVED that the above professional appointments shall be subject to fee schedules approved by the Mayor and Council of the Borough of Beachwood; and

BE IT FURTHER RESOLVED that the required “Notice of Contract Awards” shall be published in the legal newspaper as required by law within ten (10) days of its passage.

NOTICE
RESOLUTION 2019-22 AUTHORIZING A SPECIALIZED FINANCIAL ADVISORY SERVICES GROUP

WHEREAS, there exists a need for specialized financial advisory services in connection with the issuance of bonds or notes of the Borough of Beachwood (the “Borough”) in the County of Ocean, State of New Jersey, including the planning and development of a financing strategy and structure, coordinating the financing process, providing consulting services through the actual execution of the financing and provide follow-up reporting and analyses after the transaction is complete, and

WHEREAS, such specialized financial advisory services can be provided by Phoenix Advisors, LLC, a financial advisory group of Bordentown, New Jersey, so recognized by the financial community; and

WHEREAS, the Local Public contracts Law (N.J.S.A. 40A:11-1 et seq.) requires that notice with respect to contracts for Professional Services awarded without competitive bids must be publicly advertised;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Beachwood as follows:

(1) The financial advisory group of Phoenix Advisors, LLC of Bordentown, New Jersey, is hereby retained for 2019 to provide the specialized financial advisory services necessary in connection with the issuance of bonds or notes by the Borough not to exceed $17,500.

(2) The Contract is awarded without competitive bidding as a “Professional Service” in accordance with the Local Public Contracts Law; N.J.S.A. 40A:11-5(1) (a), because it is for services performed by persons authorized by law to practice a recognized profession.

(3) The Mayor and Clerk are hereby authorized and directed to execute an Agreement with Phoenix Advisors, LLC.

(4) A notice of this action shall be printed once in a Borough legal newspaper.
